GEORGETOWN, DE — The Delaware Department of Justice has dropped driving under the influence charges against Delaware State University President Tony Allen following a successful evidence suppression motion filed by the law firm Abram, Gulab & Hutchison. The legal challenge, centered on the constitutionality of the initial traffic stop and the validity of field sobriety tests, resulted in the state dismissing the most serious charges in exchange for a plea to a lesser offense.
The case originated from a July 2025 traffic stop on Route 1 near Smyrna. While initial reports indicated that a chemical test showed a blood-alcohol level above the legal limit, Michael R. Abram, the founding attorney and principal partner at Abram, Gulab & Hutchison, argued that the evidence was illegally obtained and lacked reasonable suspicion and probable cause.
In the motion to suppress, the defense contended that the arresting officer observed minimal lane deviations with questionable evidence of creating an appreciable danger, which Delaware courts have historically found insufficient to justify a traffic stop. Furthermore, the defense highlighted that Allen had successfully passed several field sobriety tests, including counting and finger-dexterity exercises, and exhibited zero clues of impairment during the walk-and-turn test.
The motion also challenged the administration of the Horizontal Gaze Nystagmus (HGN) test, noting that the officer performed only five passes with the stimulus instead of the required six, rendering the results invalid for establishing probable cause.
“In the absence of such probable cause, the fruits of this illegal arrest, including the confirmatory chemical testing, must be suppressed. The Delaware Department of Justice dropped the DUI charge approximately three weeks after the filing,” said Abram.
The 55-year-old Allen pleaded guilty to a lesser charge of misdemeanor reckless driving and paid a $259 fine, which included court costs. Had he been convicted of drunken driving, he risked facing up to one year in prison, losing his driver’s license for one year, and facing a fine of $500 to $1,500, plus court costs.
